Judge Halts Flu Vaccine Mandate For Health Workers

A state Supreme Court judge issued a restraining order Friday against the state from enforcing the controversial mandatory vaccination.

The order came as the Public Employees Federation sued to reverse a policy requiring vaccination against the seasonal and swine flu viruses, arguing that state Health Commissioner Richard Daines overstepped his authority.

  1. It was not a STATE Supreme Court Judge. It was an Albany COUNTY Supreme Court Judge; State Supreme Court Judge Marilyn Diamond REFUSED to halt the mandatory shots last Wednesday during an Article 78 proceeding brought by Attorney Patricia Finn.

    Yesterday acting Albany County Supreme Court Judge Thomas McNamara issued a temporary restraining order after combining three cases; 3 Albany Medical Center nurses (attorney Terry Kindlon), the Public Employees Federation and the New York State United Teachers. A hearing in the case is scheduled for October 30th.
