JPMorgan Instructs Homeowners To Stop Making Payments Then Takes Their Homes


JPMorgan Chase instructed homeowners to stop making mortgage payments, as that was the only way to be considered for a loan modification, then repossessed their house when they followed the bank’s advice, a couple claims in Federal Court. “I’ve seen this happen to so many people,” their attorney said. “When they come in here to tell me their story, I can actually tell it to them.”

Faiz and Khadua Jahani sued Morgan Chase and its predecessor, Washington Mutual Bank, on their own behalf and on behalf of the public.'

Eighteen Million, Out in the Road


How cold and callous can we become? When, as a society and as a nation, we can undergo a massive earthquake under our very feet and before our very eyes, how can we just ignore its victims?

RealtyTrac, the California-based authority on property trends and valuations, projects 4.5 million home foreclosures before the end of this year. That’s 4.5 million homes, and with four people to a household that is eighteen million people. Eighteen million men, women and children put out into the road, people who must scramble to find shelter and scramble to find new schools for their children.

Last year it was 2.8 million homes or 11.2 million Americans put out into the road. In two years that is 29.2 million people just put out into the road.'

The Cartel's Collection Agency


With the foul mixture of adjustable rate mortgages, low down payments, unqualified loans, and liar loans, where potential homebuyers could not even verify that they had jobs or adequate funds to buy a house, the private International Banking Cartel inflated their US housing bubble. Then, the Cartel violently burst their bloated, thin-walled, and ephemeral bladder of toxins, they had so carefully pumped with hype, lies, and wicked intentions. Now, the Cartel is delivering their coupe de grace on some defaulting home buyers; they are siccing their private collection agency, the IRS on many of the homeless and jobless of America.

Many beleaguered, debt-ridden, jobless Americans have lost, or are about to lose, what they had left of the great American Dream: owning their own home. Lending institutions, all over the US are foreclosing on our hopes and dreams for ourselves and children with malice aforethought. These premeditated crimes of the banksters will not, however, go unrewarded by the US government, with increased income taxes, sales and value-added taxes, banker bail-outs, and "stimulus" packages, all paid for by those who are living the American Nightmare - a dark dream of intense, inescapable fear, horror, and distress.

Judge Blasts Bad Bank, Erases $525,000 Debt

A Long Island couple is home free after an outraged judge gave them an amazing Thanksgiving present -- canceling their debt to ruthless bankers trying to toss them out on the street.

Suffolk Judge Jeffrey Spinner wiped out $525,000 in mortgage payments demanded by a California bank, blasting its "harsh, repugnant, shocking and repulsive" acts.

The bombshell decision leaves Diane Yano-Horoski and her husband, Greg Horoski, owing absolutely no money on their ranch house in East Patchogue.'

Landmark Decision: Massive Relief for Homeowners and Trouble for the Banks

A landmark ruling in a recent Kansas Supreme Court case may have given millions of distressed homeowners the legal wedge they need to avoid foreclosure. In Landmark National Bank v. Kesler, 2009 Kan. LEXIS 834, the Kansas Supreme Court held that a nominee company called MERS has no right or standing to bring an action for foreclosure. MERS is an acronym for Mortgage Electronic Registration Systems, a private company that registers mortgages electronically and tracks changes in ownership. The significance of the holding is that if MERS has no standing to foreclose, then nobody has standing to foreclose – on 60 million mortgages. That is the number of American mortgages currently reported to be held by MERS. Over half of all new U.S. residential mortgage loans are registered with MERS and recorded in its name. Holdings of the Kansas Supreme Court are not binding on the rest of the country, but they are dicta of which other courts take note; and the reasoning behind the decision is sound.

JP Morgan Chase Continues Foreclosure Proceedings Despite Promised Freeze

Can we trust the banks? I guess we are leaning the answer to that question - or we will soon enough. As part of the Fighting for Our Homes Campaign, we documented the story of Gaila, who is being foreclosed upon by wholly-owned JP Morgan Chase subsidiary, EMC Mortgage. Gaila said an eviction notice was posted on her property this past weekend - while the supposed 'freeze on foreclosures' was in effect. In Gaila's case however - betraying the 'freeze' is a minor offense compared to the havoc JP Morgan Chase's EMC is wreaking across the country.

Stay Put - Produce the Note

Wall Street and its co-conspirators on Main Street had a great plan.

Step 1: Ram predatory loans down the market with fraud and deceptive marketing.

Step 2: Some of the loans will blow up, but in the aggregate it will all work out and besides, the loans will be bundled and sold off to investors (spreading the toxic waste), so who cares? Great plan, but it had a few problems.

Problem #1: It destroyed the world financial system (minor detail)

Problem #2 (And he's where it get VERY interesting...) For a loan to be valid, the lender needs to be able to produce the paperwork. Guess what? In their mad greed to screw the American people and line their own pockets, Wall Street forgot that little detail.

Many of these loans and been sliced and diced and sold and re-sold so many times that not only is the paperwork not easy to lay hands on, in some cases, it's not clear who actually owns the loan.

Here's where property law comes in. If the bank can't produce the documents and the real owner of the loan can't be identified, the contract is null and void.

You've got to hand it to Congresswoman Marcy Kaptur (and Ohio which produces a lot of great Congresspeople.)

By telling a bank to "produce the note," a homeowner can delay foreclosure by forcing the lender to prove the suing institution is actually the same which owns the debt.

Now, the banks own sloth and disorganization (and inherent dishonesty) can be used against it.

Final word: The media (and Wall Street and its criminal partners in Congress and the former Bush White House) love to call these loans sup-prime. Here's the old fashioned word: predatory.

Many of the loans that were made in the past five years that have created so many problems would have been illegal until Bush & Co not only gutted lending laws, but also literally sued states to stop them from enforcing their own lending laws.

Former governor Elliott Spitzer was the ring leader of the state movement to enforce local lending laws...and you saw what happened to him.

He's no saint (and truth be told, he's kind of a jerk) but if every politician who went to hookers was busted, Washington and all the state capitals would be ghost towns

Ohio Sherrif Orders Deputies Not To Evict

A sheriff in southwest Ohio has ordered deputies to ignore eviction orders when people have nowhere else to live.Butler County Sheriff Richard Jones says evictions in winter weather and during an economic recession are heartless and those cases should be sent back to the courts and resolved some other way.

US Activist Moves Homeless Into Foreclosed Houses

Max Rameau delivers his sales pitch like a pro. "All tile floor!" he says during a recent showing. "And the living room, wow! It has great blinds."

But in nearly every other respect, he is unlike any real estate agent you've ever met. He is unshaven, drives a beat-up car and wears grungy cut-off sweat pants. He also breaks into the homes he shows. And his clients don't have a dime for a down payment.

Rameau is an activist who has been executing a bailout plan of his own around Miami's empty streets: He is helping homeless people illegally move into foreclosed homes.

Blackwater Contracted to Evict People in Foreclosed Homes

Sources have just confirmed that mortgage loan companies are contracting with Blackwater Worldwide to assist in the eviction of people still living in foreclosed homes. Though Blackwater Worldwide has not yet confirmed this, we have several reports of Blackwater contractors stealthily lurking through Chicago in full military fatigues with camouflaged furniture dollies and armored moving vans.

Sherriff In Illinois Won't Evict In Foreclosures

Residents of foreclosed properties in Chicago and other parts of Cook County don't have to worry about deputies forcing them out. Sheriff Tom Dart says that starting Thursday his office won't take part in evictions.
Dart says he's concerned that many of the people being evicted are renters who were unaware that their landlords have been failing to pay their mortgages. He says his deputies have no way of knowing whether they're removing someone who has defaulted on a loan or someone who has been faithfully paying rent.
